STATUS OF CHECKS: There has been a delay in the processing of settlement checks. An initial distribution of settlement checks will occur on or about December 8, 2010. Subsequent distribution of settlement checks will continue to occur as claims are processed. Distribution of all settlement checks is expected to be completed on or around early February. We appreciate your patience.
If you receive a Notification of Deficient Claim Letter, please note the postmark deadline in the letter by which you must return these letters and supporting documentation, if applicable, to cure the deficiency in order for your claim to be eligible.
QUESTIONS ABOUT YOUR CLAIM: If you have questions about the status of your claim, please call 800.207.0343. Please do not call Toyota or Class Counsel with these questions, as they do not have access to claim information.
WHAT TO DO IF YOU HAVE A CRACKED WINDSHIELD:
The Final Hearing was held and the Final Order was signed on July 15, 2010. The Effective Date of Settlement was August 24, 2010. As of that date, you must bring your class vehicle to a Toyota dealer for inspection and replacement of your windshield if eligible under the terms of the settlement. Any Claim Forms claiming reimbursement where the repair or replacement occurred after the Effective Date of Settlement will not be reimbursed. If the dealer does not replace your windshield, you may appeal that decision by submitting a Denied Windshield Repair Form. PLEASE NOTE that your Denied Windshield Repair Form must be postmarked within thirty (30) days of the date your claim was denied by the dealer.

The purpose of this website is to provide a brief summary of the claims asserted in the lawsuit described below and the terms of the proposed settlement, including the benefits to which you may be entitled if you are a Settlement Class Member.
Toyota has received reports from customers suggesting that, in some instances, the windshields in their 2006 model-year Scion xBs were prone to cracking. A class action lawsuit was filed in California related to this issue. Now a nationwide settlement has been proposed in that lawsuit. If you are an eligible Settlement Class Member, the settlement provides that, for a period of six years or 60,000 miles from the date of original retail sale or lease of the vehicle (whichever occurs first) eligible owners and lessees of 2006 model-year Scion xBs (referred to in this notice as “Class Vehicles”) are entitled to one of the following benefits: (1) have one Genuine Toyota windshield replaced or repaired by an authorized Toyota dealer for free after the Effective Date of the Settlement, provided you meet certain criteria, or (2) if you are an eligible Settlement Class Member who has already paid to repair or replace a cracked Genuine Toyota windshield covered by this settlement, you will be reimbursed for one such repair or replacement upon the submission of a valid Claim Form. Limitations apply.
A Settlement Agreement was entered into by the Parties on December 22, 2009.
